Boston BERDO 2.0: Compliance Plans Due May 15, 2026 — What Building Owners Need to Know

If you own or manage a building over 20,000 square feet in Boston, you have 45 days to submit your BERDO 2.0 compliance plan.

Boston's Building Emissions Reduction and Disclosure Ordinance 2.0 — one of the nation's strictest building carbon laws — requires large building owners to file emissions reduction and disclosure plans by May 15, 2026.

Unlike NYC's LL97 which assesses per-ton penalties, BERDO 2.0 takes a different approach: buildings that fail to meet emissions standards or file compliance plans face escalating fines and potential Alternative Compliance Payments (ACPs) that fund the city's equitable emissions reduction fund.

Who Must Comply?

BERDO 2.0 covers approximately 3,500 buildings in Boston:

The 2026 Compliance Requirement

For the May 15, 2026 filing, covered buildings must submit:

  1. Annual emissions report documenting current GHG emissions
  2. Compliance plan describing the pathway to meet the 2030 emission standard
  3. Energy use benchmarking data via ENERGY STAR Portfolio Manager
  4. Building systems inventory (HVAC, lighting, envelope, hot water)
  5. Planned capital improvements with timeline and expected emissions reductions

Buildings that have already achieved their 2030 target can file an abbreviated compliance demonstration instead of a full plan.
